1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of ShiKa Exam Prep (the "Service"), which is operated by Kalesh Kumar KC ("we", "us", "our"). By creating an account or continuing to use the Service you agree to these Terms.

2. The Service

ShiKa Exam Prep is a digital exam preparation platform providing scenario-based multiple choice questions, timed mock exams and explanations for professional safety certifications, including the BCSP Certified Safety Professional (CSP) and Construction Health & Safety Technician (CHST) exams.

3. Eligibility and accounts

You must be of legal age in your jurisdiction to enter into a contract. You must provide accurate account information, keep your credentials confidential, and you are responsible for all activity under your account.

4. Acceptable use

You agree not to misuse the Service. In particular you must not:

use the Service for any unlawful, fraudulent or abusive purpose;
copy, resell, redistribute, publish, or share course content, questions or explanations;
infringe our or any third party's intellectual property rights;
interfere with the security or integrity of the Service, including by probing, scanning, scraping, or introducing malware;
share your account credentials or allow more than one person to use a single account.

5. Intellectual property

All content in the Service — including questions, explanations, mock exams, course materials, software, branding and design — is owned by Kalesh Kumar KC or its licensors and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable right to access and use the content solely for your personal exam preparation within the access period you have paid for.

6. Payments, billing and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns. By placing an order you also agree to Paddle's Buyer Terms, which cover payment processing, invoicing, taxes, currency conversion and refund handling.

Course access is sold as a one-time purchase that grants access for the number of days shown on the pricing page (currently 180 days from purchase). Access is not auto-renewing; to continue after the access period you can purchase again.

7. Refunds

Refund handling is described in our Refund Policy and, as noted above, is processed by Paddle.

8. Service level and availability

We work to keep the Service available and accurate but we do not guarantee that it will be uninterrupted, error-free, or that questions and explanations perfectly reflect any current exam. The Service is provided on an "as is" and "as available" basis, and to the fullest extent permitted by law we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have materially breached these Terms, failed to pay, presented a security or fraud risk, or repeatedly or seriously violated our acceptable use rules.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of data, or loss of goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded, such as for fraud, death or personal injury caused by negligence.

11. Indemnity

You agree to indemnify and hold harmless Kalesh Kumar KC from and against claims, damages and expenses arising out of your unlawful use of the Service, your breach of these Terms, or your infringement of any third-party right.

12. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules, unless mandatory local law in your country of residence provides otherwise.
